Kerberus Cyber Security, Inc owns and operates the Kerberus Google Chrome browser extension (the "Extension") (accessible via the Google Chrome Web Store). This Kerberus Terms of Use (the "Terms") is between you and Kerberus Cyber Security, Inc and governs your use of the Extension.

Acknowledgement and Acceptance

By installing the Extension, you acknowledge and agree to abide by these Terms, EULA Addendum (accessible at https://Kerberus.com/en/eula) and Privacy Policy (accessible at https://www.kerberus.com/en/privacy-policy). You are also bound by the Google Chrome Web Store terms and conditions and privacy policy.

Prohibited Uses

You are prohibited from:

  1. Attempting to bypass security features;
  2. Reverse engineering the Extension;
  3. Interfere with the operation of the Extension;
  4. Distributing malicious code or viruses through the Extension; and
  5. Using the Extension for illegal activities or for purposes which could cause harm to an individual or group of individuals.
User Conduct

In connection with your use of the Extension, you are also responsible for compliance with the applicable laws, regulations and policies of all applicable jurisdictions.

Intellectual Property

All intellectual property, copyright, trademark rights pertaining of Kerberus.com are owned by Kerberus Cyber Security, Inc. All other trademarks, logos, copyright used by the Extension, or its affiliated websites, belong to their respective owners.

Grant of License

Please refer to our EULA Addendum for our end user license agreement. We grant you a world-wide, non-exclusive and non-transferable right to use the Extension for any purpose which does not infringe upon existing third-party intellectual property rights. Components of the Extension or its code may be offered under an open-source license. Provisions of the open-source license may expressly override some of these Terms.

Disclaimer of Warranties

Our Extension is provided "as is". We and our suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Neither us nor our suppliers, licensors, directors, officers, shareholders, affiliates make any warranty that the Extension will be error free or that access thereto will be continuous or uninterrupted. You understand that you install the Extension at your own discretion and risk.

Money-Back Guarantee

If the Kerberus extension doesn't alert you to a scam site resulting in losing your crypto or NFTs, you can submit the incident to the Kerberus team via email to [email protected] for review. If Kerberus's investigation concludes that the cause of the loss was due to the Kerberus extension not detecting the scam site, you will get 100% of the money you paid for the active license back while retaining ownership of that license. Limitation of Liability

In no event will we, our directors, officers, affiliates or our suppliers or licensors, be liable with respect to any subject matter of these Terms under any contract, negligence, strict liability or other legal or equitable theory for:

  1. Any special, incidental or consequential damages;
  2. The cost of procurement for substitute products and services;
  3. For interruption of use or loss or corruption of data;
  4. Loss of cryptocurrencies, tokens, non-fungible tokens;
  5. Or for any amounts that exceed a total of $20 US dollars.

Kerberus Cyber Security, Inc shall have no liability for any failure or delay due to matters beyond reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.

Termination

At our sole discretion, we may terminate your access to the Extension at any time, with or without cause, with or without notice, effective immediately. All provisions of these Terms which by their nature should survive termination shall survive termination, including without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of warranty.

Governing Law

These Terms (and any non-contractual disputes/claims arising out of or in connection with them) are subject to the laws of the state of Delaware, without regard to choice or conflicts of law principles.
